A land clearing permit in Florida is usually a county or city approval, not one statewide permit, and it often covers the trees as well as the grubbing and grading. Whether you need one depends on where the parcel sits, what you remove and what happens on the lot next. State wildlife and burning rules can add steps.
Level One Grading clears lots across Hillsborough, Polk and Pasco counties, so this guide shows how those counties and the state treat clearing and trees. Rules change, so confirm the current text with your permitting office first.
Do You Need a Land Clearing Permit in Florida?
Often yes, but the answer comes from your county or city, not from the state. Counties write tree and land alteration rules for private land, and a city inside the county can have its own. Hillsborough County says you may need a permit to remove a tree in unincorporated areas, and that owners in the cities of Plant City, Tampa and Temple Terrace must contact those cities about tree removal permits (Hillsborough County).
State law adds one limit on local rules. Under section 163.045 of the Florida Statutes, a county cannot demand a permit to remove a dangerous tree on a residential lot when the owner has an arborist's documentation. That is a narrow exception, not a clearing exemption.
What Are Hillsborough County's Rules for Clearing Land and Removing Trees?
Hillsborough County says a permit is generally required to remove a tree, with exemptions for certain species such as some invasive and exotic fruit trees, while pruning does not need one (Hillsborough tree resources). Clearing is a separate approval. The county's natural resources permit covers land alteration, defined as removing vegetation or changing the topography by grubbing, tree removal, clearing, grading, filling or excavating, when no construction is involved (Hillsborough natural resources permit).
For a new home, the county says all tree removal, lot grading and land alterations require an LAL permit, applied for with the building permit, and you cannot clear a residential property before you apply for and secure it. If the lot has a wetland or other surface water, the Environmental Protection Commission joins the review.

How Does Pasco County Handle Land Clearing and Tree Permits?
Pasco County takes a different route. Its residential tree removal submittal sheet states that Pasco County does not have a lot clearing permit of any kind (Pasco tree removal submittal requirements). Trees are handled through a tree removal permit in unincorporated Pasco, and the sheet lists native trees that are in the way of construction, with a building permit approved, as one kind of removal.
The same sheet says wetlands and grand trees get additional review and conditions, and that permits carry a replanting requirement unless an exemption is granted. For a vacant parcel with no house, it points to an assigned address and a site development permit first. Call Building Construction Services at (727) 847-8126 before you assume a lot is open to clearing.
What Do Polk County and City Rules Add?
Land clearing rules by county differ, and Polk County keeps its land development rules in its Land Development Code. Confirm the current text with the county before you clear, because the code is amended over time and the land clearing permit in Florida that fits depends on the parcel.
Cities are a separate layer. A lot inside a city follows that city's tree and land development code instead of the county's, which is why Hillsborough points Plant City, Tampa and Temple Terrace owners to their own offices. Find out whether the parcel is in unincorporated county land or inside city limits, and check any HOA or deed rules too.
When Can You Skip a Tree Removal Permit in Florida?
Section 163.045 lets an owner remove a dangerous tree on residential property without a local notice, application, approval, permit, fee or mitigation, but only with the right paperwork. The owner must hold documentation from an ISA certified arborist or a Florida licensed landscape architect showing the tree poses an unacceptable risk to persons or property, and removal must be the only practical way to lower that risk below moderate.
The statute also bars a local government from requiring you to replant that tree. It defines residential property as a single-family detached building on a lot actively used for single-family purposes, so a vacant lot does not appear to qualify. Level One Grading is an excavation and grading company, not an arborist, so the risk assessment has to come from the arborist.
Which State Wildlife and Burning Rules Can Apply to Land Clearing?
Gopher tortoise land clearing has its own state rule. Gopher tortoises are listed as Threatened, and the Florida Fish and Wildlife Conservation Commission says a relocation permit must be obtained before disturbing burrows and conducting construction activities. FWC counts any work within 25 feet of a burrow as a disturbance. You may not need a permit if all development activity, including vegetation clearing and equipment staging, stays at least 25 feet from every burrow (FWC gopher tortoise permits).
Burning is a second check. The Florida Forest Service says land clearing and pile burning require a burn authorization, and piles greater than 8 feet in diameter need suppression equipment on hand (Florida Forest Service burn authorizations). Our land clearing page says debris can be chipped, hauled away or burned on-site where permitted.

What Happens If You Start Clearing Land Without a Permit?
You can lose trees you cannot put back, and the county can act. Hillsborough accepts reports of violations for tree removal, land alteration, grubbing and wetland setbacks (Hillsborough violation reports). Its permits can also come with conditions, such as replacing a tree or a payment to a restoration fund. FWC treats disturbing tortoise burrows without a permit as a violation.
If you already cleared before checking, stop work, call the permitting office, describe what was done and ask how to correct it. A written record of the work is easier to explain than a surprise inspection. Do not assume a contractor filed anything for you: ask for the permit number in writing before the job starts.
What Should You Prepare Before You Hire a Clearing Contractor?
Prepare what a land clearing permit in Florida application will ask for:
- The parcel address, and whether it is in unincorporated county land or inside a city.
- A site plan or survey with the trees to keep and the trees to remove marked.
- Arborist documentation for any tree you believe is dangerous.
- A walk of the lot for gopher tortoise burrows and wetland edges.
- A written answer on who applies for each permit.

Land Clearing Permit in Florida FAQ
Can I cut down trees on my own lot in Florida without a permit?
Sometimes, but not by default. Hillsborough County says a tree removal permit is generally required, with exemptions for certain species, and Pasco requires one for many trees. Florida law lets you remove a dangerous residential tree without one when an arborist documents the risk. Confirm with your county or city first.
Does forestry mulching need a permit too?
It can. Mulching is still clearing, and Hillsborough defines land alteration to include removing vegetation by grubbing, tree removal and clearing. Tortoise and wetland rules follow the ground, not the method. Check your parcel's requirements before the machine arrives, whichever method you choose.
Do exempt trees need a permit in Hillsborough County?
No. Hillsborough lists species that do not require a tree removal permit, such as camphor and Brazilian pepper, because of traits like being invasive (exempt trees list). In a wetland or water body, the Environmental Protection Commission regulates them instead. Check the list for your species first.
Who applies for a land clearing permit in Florida, me or my contractor?
Either can, depending on the county. Hillsborough says permits may be obtained by homeowners, their licensed tree removal contractor or a certified arborist, with a signed consent form when someone applies for the owner. Ask who applies and who schedules inspections, and get the answer in writing.
